Gujarat Factory Law Amendment, 2025

Context: The Gujarat government has amended the Factories Act, 1948 via the Factories (Gujarat Amendment) Ordinance, 2025, effective July 1, introducing key changes:

1. Night Shifts for Women

  • Women can now work night shifts (7 p.m. to 6 a.m.).

  • Mandatory safeguards:

    • Written consent from female workers.

    • Minimum 10 women per shift.

    • CCTV surveillance, adequate lighting, female security personnel, safe transport.

  • No woman can be compelled to work nights.

2. Working Hours Extended

  • Daily limit increased from 9 to 12 hours (with breaks).

  • Weekly cap remains 48 hours.

  • Written consent of employees required for 12-hour shifts.

3. Overtime Provisions

  • Overtime wages continue at double the regular rate.

  • Quarterly overtime limit increased from 75 to 125 hours (with worker consent).

4. Other Changes

  • Maximum continuous working time without a break raised from 5 to 6 hours.

  • Aim: Boost industrial flexibility, job creation, and investment.

  • Passed through ordinance route during Assembly recess.

Significance: The changes reflect a push toward gender inclusion in industrial jobs while balancing labour rights and economic reforms.
